Since October 2022, the Practice Direction 57AD (PD57AD, previously known as the Disclosure Pilot Scheme) is now permanently incorporated into the Civil Procedure Rules (CPR) under Practice Direction 57AD. Under these directives, the approach to disclosure in civil litigation seeks to be improved with parties expected to manage the costs and complexity of the disclosure process. As a result, electronic disclosure must now be considered in any matter with electronically stored information or other documentation.

Specifically, PD57AD requires parties to “liaise and cooperate with the legal representatives of the other parties to the proceedings…so as to promote the reliable, efficient, and cost-effective conduct of disclosure, including through the use of technology.”
